We prepare cultural reports at the request of a lawyer, on behalf of defendants appearing for sentencing in the criminal courts.
Under section 27 of the Sentencing Act 2002 a defendant may request what is commonly referred to as a ‘cultural report’ or ‘section 27 report’.
These reports have a clearly defined purpose - to provide the court with a greater understanding of the defendant, taking into account their personal circumstances, values (both personal and cultural), background, upbringing and family history.
These factors, alongside the defendant’s goals for rehabilitation and their support network are compiled to provide a more complete picture to be presented to the sentencing judge.
Why request a report?
Without a cultural report, sentencing decisions are often made without a complete understanding of the defendant’s unique circumstances. In submitting a cultural report, outcomes could include, reduced sentences and options supporting rehabilitation being considered by the judge.
The report process
Once a report booking and submission requirements are confirmed, we will arrange a time to speak with your client. After this, we may also arrange meetings with advocates for your client, review information provided and undertake comprehensive research. We then present a draft to legal counsel to ensure the report is accurate and representative of the defendant before completing the final report.
